Who are we?
The services on this website are provided by Nova Productions, whose office is at 62 Ascot Avenue, Cantley, Doncaster. DN4 6HE.  The following terms and conditions listed below will apply between you and Nova Productions (herein 'Nova') for the provision of its services.  The placing of an order by you constitutes acceptance of these terms and conditions of business.  The terms do not affect the consumers' statutory rights.

Source Material
For the purpose of this contract, the term "source material" refers to all images, recordings or other items submitted by you to Nova, which are required to perform the services requested by you.  You must own copyright for the source material, or have permission for the requested duplication from the current owners of the copyrights for any part or all of the source material.
Nova provides these services on the understanding that the source material supplied by you does not infringe any copyright laws or any restrictions that may be subject to the content of the source material.   Nova is not responsible whatsoever for the content of the source and the transfers made.  Nova reserves the right to refuse services without explanation for content which Nova has deemed to cause offence to others or is considered to contain indecent, unlawful, libellous, fraudulent or misleading material.

Payment
You must submit payment with each order.

Disclaimer
The submission of source material is always done at your own risk.  Submitting source material to Nova constitutes an agreement by you that under no circumstances will Nova, its employees or agents, be deemed responsible for any loss or damage to the contents of the tapes or other physical media supplied.  In the unlikely event of loss or damage of your source material whilst in the care of Nova (whatever the cause), Nova will provide an equivalent blank replacement videotape or DVD-R. Nova's liability is limited to the equivalent value of blank tape to the tapes or other physical media supplied by you.  Nova is not liable for the loss or damage of material during transit to and from our facilities.

Indemnity
The placing of an order by you for the goods and services from Nova constitutes an agreement by you to indemnify Nova, its directors, employees and agents against any and all losses, claims, damages and expenses, including legal fees, arising from your use of these services.  Use of these services also constitutes an agreement by you to indemnify Nova, its directors, employees and agents against any claims made by third parties that your source material infringes or violates any third party right or law.

DVD Compatibility
Nova uses the DVD-R recordable DVD format for its DVD projects.  By ordering a DVD version of any service, you agree that Nova will accept no responsibility if the DVD-R created will not play on your DVD player because of compatibility problems.  It is your reasonability to check the compatibility of your DVD player before ordering.

Copyright
By ordering services from us, you authorise us to be able to utilise the images on your source materials in all media, both current & in the future, for all time, & to authorise its use to third parties without any consideration.  If you wish to opt out of this, please tick on the order form.

Force majeure
Nova shall have no liability to you for any failure to fulfil its contractual obligations or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

Modification of Terms
Nova reserves the right to modify these terms and conditions of its business at any time without prior notice.

Invalidity of Terms and Conditions
If for any reason part of these terms and conditions is unenforceable, the validity of the remaining terms and conditions shall not be affected.

Governing Law and Jurisdiction
Contracts between you and Nova shall be governed by English Law and you and Nova submit to the exclusive jurisdiction of the English courts.
